    The Thermador Canada Kitchen Design Contest is here! Take the challenge and share your best Thermador kitchen designs for the opportunity to win prizes and prestige.

    Entry is free, the rules are simple and the prizes are outstanding. The grand prize winner will receive $20,000 in Thermador appliances. The runner-up will receive $10,000 in Thermador appliances and third place receives $5,000 in Thermador appliances. Each design will also be showcased on Thermador.ca, the Thermador Facebook page, and through additional promotional activities.

  • Simply set up a profile, complete the online entry form, write a narrative of no more than 300 words, and upload your photos or computer generated colour renderings. April 14, 2014 is the deadline to enter.

    Eligibility:
    1. The 2013 Thermador Canada Kitchen Design Contest is open to professional Canadian designers, architects, builders, remodelers and kitchen dealers.
    2. Individual, team and company entries will be accepted.
    3. There is no limit to the number of entries that can be submitted by an eligible Entrant as long as each Entry features a unique Kitchen Design. However, each entrant is only eligible for one prize.


    The Kitchen Design:
    1. The kitchen design must include at least one Thermador appliances from each of the following areas: cooking, refrigeration and dishwashers as featured on Thermador.ca.
    2. Kitchen designs may include non-Thermador appliances only if Thermador does not offer a similar product in our lineup. Non-Thermador ventilation will be allowed depending on the application.
    3. If entering a completed kitchen, photos from at least two viewpoints must be submitted and all design and construction must be fully completed within the contest period of October 16, 2013 to April 14, 2014.
    4. If entering a new kitchen design, computer generated colour renderings from at least two viewpoints must be submitted.


    Entries must include all of the following:
    1. A headshot of the entrant.
    2. A minimum of two high-resolution photographs of the completed kitchen design in .jpg format or two computer generated colour renderings of a fully-functional kitchen from at least two viewpoints. Additional photos are welcomed to show various perspectives, details and "before" shots. Blueprints, floor plans, elevations and perspective drawings may be included but will not be accepted as the only means of entry. Files should be no larger than 20 MB.
    3. Colour renderings of a fully-function kitchen from at least two viewpoints. Files should be no larger than 20 MB.
    4. A brief biography of no more than 300 words of yourself and your kitchen design experience.
    5. A written narrative of no more than 300 words describing your kitchen design and trend inspiration.

  • Q. Is it necessary to use only Thermador appliances in my kitchen design to enter the contest?
    A.The kitchen design must include at least one Thermador appliance from each of the following areas: cooking, refrigeration and dishwashers. Appliances must be featured on Thermador.ca. Kitchen designs may include non-Thermador appliances only if Thermador does not offer a similar product in our lineup. Non-Thermador ventilation will be allowed depending on the application.

    Q. May I enter more than one kitchen design in the contest?
    A.Providing each kitchen design meets the criteria, there is no limit to the number of entries you submit. However, you are eligible to win only one prize.

    Q. Can I enter a kitchen design that was created by a team of designers?
    A.Yes, team entries will be accepted. The kitchen must be entered under the profile of only one team member. The entry form includes an area to enter additional names. The value of Thermador appliances will be split equally among the entrant and additional team members.

    Q. Can I enter a kitchen in the name of my design firm?
    A.Yes, company entries will be accepted. The kitchen must be entered under the profile of only one individual representing the company and the prizes will not be split.

    Q. Does professional photography or additional artwork help my chances of winning?
    A.Artwork such as blueprints, floor plans, elevation drawings and perspectives are welcomed but not required. If you do submit artwork, files should be .jpg format and no larger than 20 MB.

    Q. What type of assets do I need to include?
    A.You need to provide computer generated colour renderings of a fully-functional kitchen or photos of a finished design from at least two viewpoints. Assets should be no larger than 20 MB.

    Q. What should the narrative contain?
    A.The design narrative should fully describe your kitchen design and your inspiration for the design. You can describe what’s special about your design, and how Thermador products worked into the overall design. The narrative should be no more than 300 words. Your biography should tell us more about your experience as a designer and should also be no more than 300 words.

    Q. What is the deadline for entries and when will the winners be announced?
    A.All online entries must be completed no later than April 14, 2014, at midnight EST. Winners will be notified on or around May 12, 2014, and the winners will be announced in the fall of 2014.

    Q. Can I mail-in my entry?
    A.Only online entries will be accepted. We encourage you to enter online beginning October 16, 2013 through April 14, 2014. Simply set up a profile, complete the online entry form, write the narrative and upload your design drawings.

    Thermador Canada Kitchen Design Contest Official Rules

    Thermador Canada is looking for residential design professionals who are currently working in one of the following capacities: designer, architect, builder, remodeler, or a kitchen dealer within Canada, to submit a design of a fully functional kitchen design featuring Thermador brand appliances or products.

    Three entrants will be selected by a judging committee where the entrants’ kitchen design will be profiled in a national home magazine – see Prize section for more details and other prizes available to be won.

    NO PURCHASE OR PAYMENT NECESSARY.

    1. ELIGIBILITY: To be eligible for the Thermador Canada Kitchen Design Contest (the "Contest"), a person must: (a) be a legal resident of Canada who has reached the age of majority in his/her province or territory of residence at the time of entry; (b) be currently employed and/or is paid to design residential kitchens; (c) and is recognized within the industry as a professional residential designer, architect, builder, remodeler or is a residential kitchen dealer. Employees, officers, and directors (and members of their immediate families and the same household) of BSH Home Appliances Corporation, ("Sponsor"), its affiliates (including, without limitation, its parent, sister and subsidiary companies), the Judging Committee, advertising or promotional agencies, suppliers of materials or services related to the Contest are not eligible to participate in this Contest. For these Official Rules, "immediate family" means mother, father, sister, brother, son, daughter and spouse, including common law spouse, regardless of where they reside. The decisions of Sponsor and/or the Judge Committee are final and binding in all matters related to this Contest and the awarding of the Prizes. The Sponsor shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsor for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. The Sponsor reserves the right, in its sole discretion to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.

    NOTE: The person submitting an entry must be the person who created the kitchen design. Should any person wish to submit an entry on behalf of a company, client or a corporation, he/she must have permission from his/her employer/client to submit his/her entry on behalf of the company, client or corporation and be able to accept a prize should this person be selected as an eligible winner. If an entry is being submitted by a group of individuals, the group must designate one (1) person as the entrant for this Contest and only this individual will be eligible for a prize should he/she be selected as a winner.

    2. CONTEST PERIOD:The Contest starts at 9:00:00 am (ET) on October 16, 2013 and closes at 4:59:59 PM (ET) on April 14, 2014 (the "Contest Period"). All entries must be received by 4:59:59 PM (ET) on April 14, 2014 (the "Contest Closing Date"). A day (a “Day”) is defined as each Day during the Contest Period starting at 12:00:00 AM (ET) and ending at 11:59:59 PM (ET) except for the first day (October 16, 2013) where the Day commences at 9:00:00 am and the last day (April 14, 2014) where the Day ends at 4:59:59 PM (ET). The Contest computer system (the “Contest computer”) is used to govern all computer and time-related aspects of the Contest and, among other things, is the official time-keeping device for the Contest.

    3. PARTICIPATING PRODUCTS:To view a full listing of product availability including dimensions (available on the “specs” tab) visit www.thermador.ca. Entrants can select any product from the following categories within the Sponsors website: Refrigeration (refrigerators; freezer; bottom freezer refrigerators; wine refrigerators; side by side refrigerators); Dishwashers; Cooking (ranges; rangetops; ovens; cooktops; ventilation; warming drawers; microwaves; built in coffee machine).

    4. HOW TO ENTER THE CONTEST: Entrants, please review these Official Rules, which includes all pertinent details.

    IMPORTANT: : Residential kitchen designs must include ONLY Thermador appliances and include at least one (1) appliance from each of the following areas: cooking, refrigeration and dishwasher. For a list of participating products see Rule 3 above.

    To submit an entry visit www.thermador.ca/designercontest. Follow the instructions to complete the entry form and to upload the required documents. All entries must be received on or before the Contest Closing Date.
    An entry must include the following mandatory components:
    • Entry Form – an entrant must complete the entry form with his/her first name, last name, company name, complete mailing address, daytime telephone number, date of birth, email address. Tick the box if you would like to opt in to and receive future email communications from the Sponsor about product news and promotional offers.
    • Biography – an entrant must include a brief biography (up to 250 words in English or French) about him/her and his/her experience in designing residential kitchens.
    • Narrative – an entrant must include a description of his/her residential kitchen design and trend inspiration (up to 250 words in English or French).
    • Renderings – an entrant must include (upload) a minimum of two (2) computer generated colour renderings of his/her residential kitchen design and/or two (2) colour photographs (renderings and photo(s) must be from at least two (2) different viewpoints). NOTE: Entrants can submit colour renderings and photographs from a previously completed project; however, the completed project must have been completed after January 2013 and contain at least one (1) Thermador appliance from each of the following areas: cooking; refrigeration and dishwasher.
    • List of elements - an entrant must include a list of all Thermador appliances included in the residential kitchen design.
    • Select “Submit” once you have completed the above. Upon receipt you will receive a “Thank you” message.

    The following are the file format and size requirements for the Submission:
    o Images in Adobe “pdf”, “jpeg” or “tiff” format
    o Each file can be no larger than 20 MB.

    NOTE: Upon receipt of an entry, the Sponsor reserves the right, in its reasonable discretion, to request that an entrant re-submit his/her entry which fails to comply with the entry requirements. Should such requests occur the entrant must re-submit any missing elements on or before the Contest Closing Date. If any entrant does not respond his/her entry will be disqualified without any liability to the Sponsor.

    RULES REGARDING ENTRIES:
    Entries: (1) must be the entrant’s original creation. Modifying, enhancing or altering a third party's pre-existing work does not qualify as an individual’s original creation and is strictly prohibited; (2) must not violate the rights of any third party. For example, an entrants entry must not defame, infringe or violate publicity or privacy rights of any person, living or deceased, or otherwise infringe upon any person’s, entity’s or organization’s personal or proprietary rights, including but not limited to, intellectual property rights such as copyright; (3) must not have been published previously, used commercially, submitted to another contest or promotion, or won any other award; (4) must be in “good taste” and must not be explicit or offensive, as determined by the Judging Committee and/or Sponsor, in its or their sole and absolute discretion; and, (5) must not contain any commercial content that promotes any product or service other than those offered by the Sponsor. An entrant’s right to submit an entry must not be restricted in any way. Sponsor’s right to use the entry shall not be restricted. Upon request, an entrant must provide legal written releases for Sponsor’s unrestricted use of any entry that includes a third party’s name, likenesses, or work ("Third Party Elements") in a form satisfactory to Sponsor at the time of notification.

    Sponsor’s Rights to the entry: The below paragraph will apply to any selected winner’s work, including not only the entry but the kitchen design. By submitting an entry and if applicable creating the entrant’s kitchen, the entrant: (1) irrevocably, perpetually, and without limitation, grants to the Sponsor and its affiliates and assigns the right to use, publish, adapt, sub-license, edit, display, reproduce in whole or in part, dispose of, and/or modify such entry and if applicable the kitchen design and the concepts and Third Party Elements embodied therein in any way, in commerce, and in any and all media worldwide, and waive all his/her rights, including moral rights, in the entry and if applicable the entrant’s kitchen design, without notice or compensation, and agree that he/she may be required to sign a release to that effect. This includes but is not limited to Sponsor’s use of his/her concept plan and/or renderings, final kitchen design, and otherwise in any marketing, advertising and promotional materials, without notice or compensation to the entrant and/or winner, or any other third party; (2) agree to irrevocably assign and transfer to or waive in favour of the Sponsor any and all rights, title, interest and claim, which he/she now has or may have in the future, to the entry and if applicable to the kitchen design, and the concepts and Third Party Elements embodied therein, including without limitation, the copyright and/or moral rights therein, and sales, and licensing rights; (3) agree to not upload, download, distribute, disseminate, copy, reproduce his/her entry or the kitchen design or otherwise cause his/her entry to be on any public website except for the Contest website and, (4) warrant that his/her entry and kitchen design does not contravene or infringe on anyone else’s copyright or other intellectual property, is not false, inaccurate or misleading & does not violate any law or regulation; is not libellous, threatening or harassing; does not instigate others to commit illegal activities; and does not contain pornography; does not contain any viruses, worms, or other computer programming intended to or that could interfere with the ability of others to enjoy the Contest Website or email account. The Sponsor reserves the right to reject any entry, which the Judging Committee or the Sponsor, in its or their sole and absolute discretion, determines does not meet these Official Rules.

    5. LIMIT OF NUMBER OF ENTRIES: : Limit of one (1) entry per Day during the Contest Period however each entry must be unique. A person may only use one (1) first and last name, telephone number, complete mailing address, and one (1) e-mail address to participate in the Contest. Any person who is found to have entered the Contest with more than one (1) first and last name, telephone number, complete mailing address, or e-mail address will be disqualified and all such entries received from such person during the Contest Period will be disqualified and no Prize will be awarded to such person. Proof of transmission (screenshots or captures etc) or attempted transmission of a entry or attempted submission of any communication, does not constitute proof of delivery or receipt by the Contest Computers. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. The Sponsor will not be responsible for late, lost, illegible, falsified, damaged, misdirected, mutilated, garbled or incomplete entries, which will be void. All entries become the property of the Sponsor upon receipt and none will be returned

    6. PRIZES: There are a total of three (3) Prizes available to be won.
    a. GRAND PRIZE: There will be one (1) Grand Prize available to be won. The Grand Prize consists of a $20,000 CDN credit towards the future purchase of Thermador appliances either for the winner’s kitchen or one of his/her clients kitchens and an opportunity for the entrant to have his/her kitchen design showcased on the Thermador.ca website, Thermador Facebook page, and at the Sponsor sole discretion through additional promotional activities such as print, websites and/or social media sites. The Prize must be accepted as awarded and cannot be transferred, exchanged, substituted, or redeemed for cash except at Sponsor's sole and absolute discretion. The $20,000 CDN credit must be used by December 31, 2014. If the cost of the selected appliance or appliances is greater than $20,000 CDN the winner must pay the difference between the cost of the appliance or appliances and any applicable taxes and delivery charges before the appliances will be delivered. Delivery of the appliance must be within the winner’s province. If delivery of the Thermador appliances are not for the winner’s kitchen, the winner must provide sufficient proof that he/she is handling the kitchen renovation project to where the appliances are being delivered to. The winner must also provide to the Sponsor consent that the home owners grant the winner and the Sponsor permission to use the photographs of the completed kitchen design in any future media. The manufacturer’s standard warranty applies to the appliances delivered. If the cost is less than $20,000 CDN the winner will not receive the difference in cash, cheque or credit. The winner must also make himself/herself available to the Sponsor between the time of being confirmed a winner and December 31, 2014 to work with the Sponsor on his/her kitchen design; promotional opportunities; press releases or any other forms of media as required by the Sponsor.
    b. SECOND PRIZE: There will be one (1) Secondary Prize available to be won. The Secondary Prize consists of a $10,000 CDN credit towards the future purchase of Thermador appliances either for the winner’s kitchen or one of his/her clients kitchens and an opportunity for the entrant to have his/her kitchen design showcased on the Thermador.ca website, Thermador Facebook page, and at the Sponsor sole discretion through additional promotional activities. The approximate retail value of the Second Prize is $10,000 CDN. The $10,000 CDN credit must be used by December 31, 2014. If the cost of the selected appliance or appliances is greater than $10,000 CDN the winner must pay the difference between the cost of the appliance or appliances and any applicable taxes and delivery charges before the appliances will be delivered. Delivery of the appliance must be within the winner’s province. If delivery of the Thermador appliances are not for the winner’s kitchen, the winner must provide sufficient proof that he/she is handling the kitchen renovation project to where the appliances are being delivered to. The winner must also provide to the Sponsor consent that the home owners grant the winner and the Sponsor permission to use the photographs of the completed kitchen design in any future media. The manufacturer’s standard warranty applies to the appliances delivered. If the cost is less than $10,000 CDN the winner will not receive the difference in cash, cheque or credit.
    c. THIRD PRIZE: There will be one (1) Third Prize available to be won. The Third Prize consists of a $5,000 CDN credit towards the future purchase of Thermador appliances either for the winner’s kitchen or one of his/her clients kitchens and an opportunity for the entrant to have his/her kitchen design showcased on the Thermador.ca website, Thermador Facebook page, and at the Sponsor sole discretion through additional promotional activities. The approximate retail value of the Third Prize is $5,000 CDN. The $5,000 CDN credit must be used by December 31, 2014. If the cost of the selected appliance or appliances is greater than $5,000 CDN the winner must pay the difference between the cost of the appliance or appliances and any applicable taxes and delivery charges before the appliances will be delivered. Delivery of the appliance must be within the winner’s province. If delivery of the Thermador appliances are not for the winner’s kitchen, the winner must provide sufficient proof that he/she is handling the kitchen renovation project to where the appliances are being delivered to. The winner must also provide to the Sponsor consent that the home owners grant the winner and the Sponsor permission to use the photographs of the completed kitchen design in any future media. The manufacturer’s standard warranty applies to the appliances delivered. If the cost is less than $5,000 CDN the winner will not receive the difference in cash, cheque or credit.

    Prizes must be accepted as awarded without substitution and are not transferable or for resale or convertible to cash. The Sponsor reserves the right, in the event that any Prize or any component of a Prize cannot be awarded as described for any reason, to substitute a similar Prize or component of equal or greater value without liability. Limit one (1) prize per person, group or registered business/corporation.

    7. SELECTION PROCESS:

    JUDGING COMMITTEE: The Judging Committee, will be comprised of up to five (5) individuals (the “Judges”) at the sole discretion of the Sponsor. Decisions of the Judges are final and binding on all matters relating to this Contest.
    SELECTION CRITERIA: The Judges will review all entries received and score each entry based on the following Criteria:
    • Best use / placement of Thermador appliances within the kitchen design
    • Visual appeal, creativity and design quality
    • Strong elements and principals of a kitchen design
    • Overall functionality of the kitchen design
    • Adheres to the assignment herein defined as the “Criteria”.
    The total possible points an entry may receive is 100. Each Criteria will be weighted equally.

    The entry that receives the highest overall score will be selected as the eligible Grand Prize winner. The entry that receives the second highest overall score will be selected as the eligible Second Prize winner. The entry that receives the third highest overall score will be selected as the eligible Third Prize winner. Odds of your entry being selected depend on the number and quality of entries received by the Contest Closing Date. The selection process will commence on April 21, 2014 and conclude on May 9, 2014. In the event of a tie, the tied entries will be judged according to the Criteria as set out above by an additional Judging member who will serve as the tiebreaker. If an entry is not selected as a winner, the entrant has no recourse, regardless of whether his/her entry is similar in content or likeness to any Prize winner.


    8. WINNER CONFIRMATION: To be confirmed a winner, each selected entrant must: (i) reply to potential winner notification within the indicated time frame by email, mail, courier or telephone; (ii) correctly answer without assistance of any kind, whether mechanical or otherwise, a time-limited, mathematical skill-testing question; (iii) be in full compliance with these Official Rules; and (iv) sign and return via registered mail, express mail or courier delivery within indicated time frame of it being sent, Sponsor’s Declaration of Compliance with these Official Rules and a Release of Liability and Publicity Release form ("Prize Form"). If any selected individual cannot be contacted and confirmed a winner as above, he/she will be disqualified at the sole and absolute discretion of the Sponsor and/or Judging Committee, his/her entitlement to receive a Prize will be forfeited and the next eligible entry will be selected. No correspondence will be entered into except with selected individuals.

    9. RELEASE OF LIABILITY CONSENT TO PUBLICITY: By completing and returning the Prize Form, and accepting the Prize, a winner: (i) confirms compliance with the Official Rules; (ii) acknowledges that the Prize is not transferable, and must be accepted as awarded; (ii) consents to the use of his/her name, image, address (city and province), concepts, renderings, kitchen design, photographs, images or illustrations submitted, statements regarding the Contest or the Prize and/or voice, without further remuneration, in connection with any publicity carried out by or on behalf of Sponsor with respect to the Contest in any media whatsoever; and (iv) releases Sponsor, its affiliates (including, without limitation, its parent, sister and subsidiary companies), advertising and promotional agencies, the Judging Committee, suppliers of materials or services related to the Contest and all of their respective shareholders, directors, officers, employees and agents (collectively, the "Releasees") from and against all liability in connection with the Contest and/or the awarding and/or use of a Prize, including, as set out below in the LIMITATION OF LIABILITY section and consent to irrevocably assign and transfer to or waive in favour the Sponsor any and all rights, title, interest and claim, which they now have or may have in the future, to the entry and to the kitchen design created, and the concepts and Third Party Elements embodied therein, including without limitation, the copyright and/or moral rights therein.

    10. LIMITATION OF LIABILITY: The Releasees do not assume any responsibility and individuals release the Releasees from any and all claims, actions, damages, demands and liabilities of whatever nature or kind arising out of, or in connection with the individuals participation or attempted participation in the Contest, including, without limitation the administration of the Contest, the selection and confirmation of a winner, and the arranging, awarding and use of any Prize. Without limiting the generality of the forgoing, the Releasees are not responsible for (i) the incorrect or inaccurate capture of entry information; (ii) late, lost, stolen, illegible, contain false information, damaged, misdirected, mutilated, garbled or incomplete entries, or entries that are altered or otherwise irregular, have been submitted through illicit means or do not conform with or satisfy any or all of the conditions of the Official Rules; (iii) any loss, damage, or claims caused by the awarded Prize or the Contest itself; (iv) any failure of the website or email account during the Contest Period, including, without limitation, any problems, human or technical, printing errors, lost, delayed, garbled data or transmissions, omissions, interruptions, deletions, defects or failures of any telephone or computer lines, technical malfunctions of any computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including, without limitation, any injury or damage to an individual’s or any other person’s computer related to or resulting from participating in or downloading any material connected to the Contest, all of which may affect a person's ability to participate in the Contest; (v) any errors, omissions, incorrect or inaccurate information in any Contest-related materials, including, without limitation, printing or advertising errors or failure of, or problems with any equipment or programming associated with or used in the Contest howsoever caused; (vi) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer "hackers" or otherwise or (vii) any claims regarding the accepting, arranging, awarding or use of any Prize. Entry material/data that has been tampered with or altered is void.

    11. CONDITIONS OF ENTRY: By entering the Contest, individuals agree to read and abide by these Official Rules and the decisions of the Judging Committee and Sponsor, made in their sole and absolute discretion, which shall be final and binding in all matters relating to this Contest and the awarding of a Prize. Individuals who have not complied with these Official Rules are subject to disqualification.

    12. UNSPORTSMANLIKE CONDUCT: Sponsor reserves the right, in its sole and absolute discretion, to disqualify any individual that it or Judging Committee finds to be: (a) violating the Official Rules; (b) tampering or attempting to tamper with the entry process or the operation of the Contest or the Contest Website or email account; (c) acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person or (d) attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives. If the Sponsor suspects that an individual has engaged in an unsportsmanlike or disruptive manner, the individual will be contacted as soon as practicable. Caution: Any attempt by an individual or any other individual to deliberately damage any website associated with this Contest or to undermine the legitimate operation of this Contest may be a violation of criminal and/or civil laws. Should any such attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law and to ban or disqualify an entrant from this and future Contest.

    13. DISPUTE REGARDING THE IDENTITY OF AN ENTRANT: Eligible entrants will be the person who registered and who submitted the entry. If a dispute arises regarding who submitted an entry, the entry will be deemed to have been submitted by the authorized account holder of the e-mail address provided at the time of entry provided the name of the authorized account holder corresponds with the full name on the entry form. The authorized account holder is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. If the name of the authorized account holder does not accord with the full name on the entry form, the entry may be disqualified at the Judging Committee and/or Sponsor's sole and absolute discretion.

    14. GENERAL: The Sponsor and the independent contest organization do not assume any responsibility and are not responsible for: (i) the incorrect or inaccurate capture of registration information ; (ii) entries which fail to comply with the Official Rules; (iii) any loss, damage, or claims caused by the awarded Prize or the Contest itself; (iv) any failure of the website or email account during the Contest Period, including any problems, human or technical error, printing errors, lost, delayed, or garbled data or transmissions, omissions, interruption, deletion, defect or failures of any telephone or computer lines, or technical malfunction of any computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail; or on-line registration to be received on account of technical problems or traffic congestion on the Internet or at any website or email account, or any combination thereof including any injury or damage to an entrant's or any other person's computer or other electronic devices related to or resulting from downloading any material in the Contest, all of which may affect a person’s ability to participate in the Contest; or (v) any other matter whatsoever. Entries, material or data that has been tampered with or altered are void. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, (i) the laws of the Province of Québec and construed in accordance with the Federal, Provincial, and Municipal laws applicable therein in respect of residents of the Province of Québec, and (ii) the laws of the Province of Ontario and construed in accordance with the Federal, Provincial, and Municipal laws applicable therein in respect of residents of the other Canadian provinces and territories, without regard to conflicts of law principles.

    15. This Contest is void where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations. Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux, to terminate, modify, or suspend this Contest or to amend the Official Rules at any time and in any way, without prior notice, for any reason whatsoever. Without limiting the foregoing, if for any reason the Contest is not capable of running as originally planned, for example as a result of tampering or infection by computer virus, Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux, to terminate the Contest and conduct the selection process from all previously received eligible entries.

    16. RULES GOVERN: In the event of any discrepancy or inconsistency between the Official Rules and disclosures or other statements contained in any Contest related materials, including, but not limited to, the entry form , the Official Rules shall prevail, govern and control.

    17. QUEBEC RESIDENTS: Any litigation respecting the conduct or organization of a publicity contest in Québec may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie des alcools, des courses et des jeux only for the purpose of helping the parties reach a settlement.

    18. CONSENT TO USE PERSONAL INFORMATION: The Sponsor respects your right to privacy. If you consented on the entry form, the Sponsor may use the information you provide to initiate, maintain, and develop a relationship with you in connection with the offering of the Sponsor’s products or the promotion and marketing of additional products and services offered by the Sponsor. If you did not consent on the Entry Form, the information you provided will only be used for the purpose of administering this Contest in accordance with the terms of our privacy policy at Thermador.ca/privacy.
